Power of Attorney Documents

At least once or twice a month we get a call from someone who has an aging parent with some level of dementia and they are seeking to get power of attorney documents over their parent so that they are able to take care of them and manage their affairs.

Sometimes, depending upon the circumstances, and the severity of the dementia, we are able to assist in getting these documents executed. Sometimes, they have waited too long and the parent no longer has the capacity to sign the document and give away that authority.

Simple Documents to Avoid Complex Problems

Often times, having these simple documents in place will avoid the difficult and expensive process of seeking a court ordered Guardianship. They are so important that they are generally included in every estate plan.

Power of Attorney Documents, like everything else need to be updated from time to time. Every once in a while, the laws change and your POA (Power of Attorney) documents should comply with the current law. More often than not, the people you named as your agents need to be changed for one reason or another.

We are often asked, “is my out of state POA valid in Florida?” The short answer is “probably” because states generally recognize each other’s legal documents. However, if you are now a Florida resident it is wise to have POA documents that fully conform to Florida law.
