Do I need a will or do I need a trust? Last Will and Testament

A will, often called your “Last Will and Testament”, is your declaration to the world of how you want your assets divided at your passing. It also allows you to leave someone you trust in charge of carrying out your wishes. In Florida, that person is called your “Personal Representative”. Your Personal Representative will guide your estate through the probate process, usually with the assistance of an attorney.

Probate Process

As a general rule, the probate process is something that most of us want to avoid. Even with a Will, if the person does some very basic pre-planning, their entire estate can pass to their heirs without ever going through the probate process.
