What the Heck is Probate?

I’m glad you asked. Probate is the court process of administering your estate after you die. Basically that means settling your affairs and distributing your stuff.

It is generally something we all want to avoid. It is considered to be a completely avoidable process and an unnecessary expense that results from poor planning.

In a nutshell, it is the court process that settles the affairs of the decedent, (pays all the bills) and then ultimately distributes the assets to the named beneficiaries.

Florida Probate

In Florida there are two types of probate cases. For small estates, $75,000.00 or less, there is Summary Administration. This small estate probate has a lot less court rules and procedures so it can usually be settled within six months.

If the estate is larger than $75,000.00 the law requires that it be administered by formal probate Administration and that you must retain an attorney to guide the process.

People Hate Probate for Two Reasons:

It is generally a long, slow process. Most formal probate case take about a year to complete.
It is expensive. The law says that a lawyer must charge a reasonable amount for probating an estate. Then the next part of the law says that a reasonable amount is 3%. So most lawyers want to be reasonable so they usually charge about 3%. Three percent of a $500,000.00 estate is a $15,000.00 legal fee.
