Revocable Living Trust

In the world of estate planning there are many types of trusts but the most common type is the Revocable Living Trust. This type of estate planning tool is a great way to avoid the probate process. It also can be structured to protect you and your spouse while you are still alive but incapacitated in some manner. Similar to a will, the revocable trust is your voice, your declaration to the world of how you want your estate distributed and it allows you to have a much larger degree of control than you would have with a simple will.

Advantages of Revocable Living Trusts

Some of the advantages of a revocable trust are:

Assets within the trust avoid the costly and lengthy probate process
Unlike a will, a trust is completely private and not a court process.
All income of the trust flows directly to the Grantor’s tax 1040 form
Place your homestead in the trust without losing any Constitutional protections..
Distribute your assets with your rules attached
Can be structured to provide for a Special Needs Beneficiary
Uses the Grantor’s social security number. No EIN required.
Can hold out of state real estate and avoid additional probate administration.

Some of the disadvantages of a revocable trust are:

Revocable trusts are more expensive to set up than a simple will
Assets must be redirected or retitled to the trust
Revocable trust DO NOT protect your assets from creditors
